Deferred Sentence

Deferred Sentencing is when the court delays (or “puts off”) sentencing to give someone a chance to meet certain requirements first. Instead of imposing a jail or prison sentence right away, the judge sets conditions—often things like counseling, classes, community service, staying out of trouble, and checking in with the court or probation. In California criminal cases, a deferred sentence is most commonly offered to people who are low-risk and have little to no prior record—often first-time offenders— because the goal is rehabilitation rather than punishment. If the person successfully completes everything the court orders, the charges may be dismissed, or the person may receive a punishment that is less than what would have been otherwise imposed.
