ou must submit to either a Breathalyzer or a blood test. You are not required to submit to field sobriety or PAS testing. A PAS device is a form of breathalyzer that is not admissible in court except to establish probable cause. The admissible breathalyzer is usually in a big yellow box or at the police station.
Field sobriety tests will almost always result is “signs of intoxication”. We do not recall any case in which an officer didn’t claim to see signs, even with not supported by the body camera footage. Asserting your rights is not an admission of guilt. Don’t be bullied in to taking tests that do nothing but help the officer to justify your arrest.
