Illegal Storage of a Firearm

Our client lived with her father. Her son came to visit for the day and was asleep in her bed. She got into an argument with her father and the police were called. Her father indicated that she owned a firearm and that her son is a prohibited possessor. Police found the gun in a closet that was screwed shut to the point that the police struggled to get access. The gun was buried under multiple items and was missed during the initial searches. Our client was charged with allowing a felon to have access to a gun.
Obviously, we argued that there was no evidence that the son knew about the gun and that the gun was hidden and secured. We further pointed out that the son was visiting and did not live in the home. The result was a full dismissal.
