What is: Diversion

Diversion is a method of resolving certain California criminal cases without a traditional conviction and, in some cases, the sealing of an arrest record. There are several types of diversion and the defendant’s charges and other factors determine eligibility for each.

Similar to a plea in abeyance, the case is put on hold for a period of time. However, diversion typically does not require the entry and holding of a guilty plea. Conditions of diversion typically include classes, counseling or treatment, community service, restitution. Terms of diversion also include no new law violations.

Diversion is a great option for young defendants, veterans, substance abuse and those with no criminal record. It is also a great option for those with jobs that will be impacted by an arrest record or conviction. Some forms of diversion will seal the arrest record limiting the number of employers that can access the records.
